He puts a lot of emphasis on the "repeat" provision.

If I dictate a letter to a typist that constitutes publication,
however in the internet world each access is a publication
so if I place content on a web page once, and it is accessed
6000 times there are 6000 publications.......so much for
"repeats".....

and anyway the real objection is the absence of evidentiary
standard. Incidentally the EU rejected a similar proposal, strange that :) 
- you may assume that this was not a home grown solution......

As he points out however even the US resiled from that solution....
